Terms of Service

By accessing or using OFV Studio (the "Platform") or the OFV Live mobile application (the "App"), operated by Old Fashioned Sports LLC ("OFV," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services. Your continued use of the Platform following any changes to these Terms constitutes your acceptance of those changes.

OFV Studio provides volleyball clubs with tools to live-stream matches to YouTube, manage real-time scoring overlays, and organize match schedules. The OFV Live mobile app is a companion application for RTMP streaming and match management, available on iOS and Android.

The OFV Live mobile app is available free of charge. Premium features are available via subscription plans managed through OFV Studio on the web at ofvlive.com. No purchases are made through the Apple App Store or Google Play Store.

We strive to maintain high availability but do not guarantee uninterrupted service. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the confidentiality of your login credentials and admin PIN
• Be responsible for all activity that occurs under your account
• Notify us immediately of any unauthorized use at [email protected]

One club account may have multiple members with varying roles (owner, admin, member). You may not share authentication tokens or stream keys with unauthorized parties.

OFV Studio offers a free tier and paid subscription plans providing access to additional features. All subscriptions and billing are managed through our web platform at ofvlive.com using Stripe as our payment processor.

• Free tier: 5 matches per month, 3 stream keys. Free Starter matches automatically end after 60 minutes.
• Paid subscriptions are billed monthly via Stripe. You may manage your subscription, update payment details, or cancel at any time through your account billing portal.
• Subscriptions automatically renew at the end of each billing period at the then-current rate unless cancelled at least 3 days before the renewal date.
• Cancellation takes effect at the end of the current billing period. No prorated refunds are issued for partial months, except where required by applicable law.
• If you believe you were charged in error, contact us at [email protected] within 30 days of the charge.
• We reserve the right to change pricing with 30 days' notice to active subscribers via email.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of applicable laws
• Stream content that infringes any copyright, trademark, or other intellectual property right
• Stream content that is defamatory, harassing, obscene, or otherwise objectionable
• Stream content that violates YouTube's Community Guidelines or any destination platform's terms
• Attempt to access another club's data, streams, or administrative controls
• Interfere with or disrupt the Platform, servers, or networks connected to the service
• Reverse-engineer, decompile, or attempt to extract the source code of the Platform or App
• Use automated scripts, bots, or scrapers to access the Platform without our written consent
• Share stream keys, admin PINs, or authentication tokens with unauthorized parties

You retain full ownership of all content you stream through OFV Studio, including video and match data. OFV does not claim ownership of your content and uses it only to provide and improve our services.

OFV Studio does not record, store, or retain live stream video content. When you initiate a stream, your video is transmitted directly from your device to your designated destination platform (such as YouTube) and is not stored on OFV's servers. You are solely responsible for the content you stream and for compliance with the terms of any destination platform.

This application uses YouTube API Services. By using OFV Studio to stream to YouTube, you agree to be bound by the YouTube Terms of Service and the Google Privacy Policy. OFV is not affiliated with, endorsed by, or sponsored by Google or YouTube.

You are solely responsible for ensuring you have the right to stream and record the events you broadcast, including venue permissions and consent of participants.

Each destination platform has its own terms of service and content policies. You are responsible for complying with the terms of all platforms to which you stream. OFV is not responsible for any action taken by a destination platform in response to your content, including removal of streams, suspension of accounts, or enforcement of copyright claims.

Live streaming is subject to network conditions, device limitations, and third-party platform availability. OFV shall not be liable for stream interruptions, quality degradation, or failures for any reason including network congestion, YouTube API changes, outages, or device limitations.

Clubs using OFV Studio to stream events featuring minors (individuals under 18) are responsible for:

• Obtaining all necessary parental or guardian consents to record and stream the images and likenesses of minors
• Complying with all applicable laws regarding the recording and broadcast of minors
• Maintaining their own policies consistent with their organization's rules and applicable local regulations

By streaming an event featuring minors, you represent that you have obtained all required consents and you agree to indemnify OFV for any failure to do so.

OFV Live and OFV Studio are designed for use by adults — club administrators, coaches, and parents. You must be at least 18 years of age to create an account or use the Service. OFV Live is not intended for players; players appearing in streams are filmed incidentally and do not use this app.

If we learn that a user is under 18, we will terminate their account and delete their personal information promptly. If you believe a person under 18 has created an account, please contact us at [email protected].

Your use of the Platform is governed by our Privacy Policy, which describes how we collect, use, and protect your data.

• Club data is isolated using row-level security. Each club can only access its own data.
• Player information is provided by club administrators and is their responsibility to maintain accurately and with appropriate consent.
• You may request export or deletion of your data by contacting [email protected].

We strive to maintain high availability but do not guarantee uninterrupted service. Live streaming depends on your internet connection and YouTube's infrastructure. We may perform maintenance that temporarily affects service availability and will provide reasonable notice when possible. We are not responsible for interruptions caused by YouTube API changes, outages, or rate limits beyond our control.

All content, features, and functionality of the Platform — including software, text, graphics, logos, and scorebug overlays — are the exclusive property of Old Fashioned Sports LLC or its licensors. You may not copy, modify, distribute, sell, or lease any part of the Platform without prior written consent from OFV.

The service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. OFV does not warrant that the service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

To the maximum extent permitted by applicable law, OFV shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:

• Loss of data, revenue, or business opportunities
• Interruption of streaming services during matches or tournaments
• Unauthorized access to your account due to compromised credentials
• Actions taken by YouTube or any third-party platform regarding your channel or content

Our total liability for any claim arising from your use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

You agree to defend, indemnify, and hold harmless OFV, its officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) the content you stream through the Service.

• You may close your account at any time by contacting us or through your account settings.
• We may suspend or terminate your account if you violate these Terms, with notice when reasonably possible.
• Upon termination, your club's data will be retained for 30 days to allow export, then permanently deleted.
• YouTube broadcasts already published to your channel will remain unless you delete them separately on YouTube.

Sections 6, 12, 13, 14, 15, and 18 survive termination of these Terms.

OFV respects intellectual property rights. If you believe content accessible through our Platform infringes your copyright, please send a notice to [email protected] including: (a) identification of the copyrighted work; (b) identification of the infringing material; (c) your contact information; (d) a good faith belief statement; and (e) a statement of accuracy under penalty of perjury. OFV will respond to valid notices in accordance with applicable law.

These Terms shall be governed by and construed in accordance with the laws of the state in which OFV is incorporated, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction to prevent intellectual property infringement. You and OFV each waive any right to participate in a class action lawsuit or class-wide arbitration. Either party may bring an individual claim in small claims court.

We may update these Terms from time to time. We will notify active users of material changes via email. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.
